Introduction

For most cases, the claims process can be fairly straightforward once the validity of the claim has been established. For larger claims, a loss adjustor will be appointed by the insurance company. Although their fees are paid by the insurance company, they are a professional group that is independent. One of their responsibilities is to ensure the claimant receives all they are entitled to, and no more. They will do the following:

  • establish that an insured event has taken place
  • establish that the insured event is covered by a current and valid insurance policy
  • establish the cause of the claim
  • establish the insured cost impact of the claim

If a claimant appoints a Loss Assessor to establish the cost of a claim, their fess will be paid by the claimant and can't be recovered from the insurer.

Some reasons claims are rejected

This is no-where near an exhaustive list but is simply intended to give a few examples of reasons that claims can be rejected

The event was not an insured event.

  • loss of stock following a break-in but no stock is covered on the policy
  • A vehicle is stolen but only Third Party cover is in place
  • An employee is injured but no Employers' Liability cover is in place
  • Professional negligence by the builder is not covered under Public Liability insurance.

The conditions of the policy have not been met.

  • key locked windows were not installed despite being required,
  • stock was not not stored 6" above floor level
  • the driver of a vehicle was not insured to drive
  • Failure to set the intruder alarm when the property is unoccupied.

Proof of loss can't be established

  • no police report was obtained following a theft
  • stock records are not up to date and proof of volume and value of stock can't be established

A non-disclosure by the policy holder.

  • Failure to declare a flat roof on a property
  • Failure to declare a conviction for fraud
  • Failure to declare a speeding conviction

Fraud

  • the claimant has exaggerated losses and presented a fraudulent claim, making the WHOLE claim invalid
  • the claimant has lied about the circumstances surrounding the claim
  • The claimant was guilty of a criminal act that has led to the claim
